CHILDREN AND PARENTS ARE GUARANTEED RIGHTS UNDER THE IDEA
The Individuals with Disabilities Education Act (IDEA) sets forth several legal mandates for children with disabilities and their parents. Under the IDEA, along with other important rights, your child with special needs is entitled to a free appropriate public education in the least restrictive environment. Attorney Molly Watson helps families secure and protect these rights.

DUE PROCESS RIGHTS GUARANTEED UNDER IDEA
Under the IDEA, you have the right to resolve disputes with your school district through due process. Simply stated, special education due process is a formal legal process to resolve these disputes.
Before invoking due process, depending on your circumstances, you may try to resolve the dispute through informal means. For example, you might discuss the problem with your child's teacher or school principal, or you might request an IEP team meeting to discuss your concerns. Please note, that you are not obligated to engage in informal negotiations, but sometimes they may resolve a problem.
The basic steps of due process include:
Resolution meeting, which is mandatory unless you and the school district agree to waive it
Mediation, which is only provided if both you and the school district voluntarily agree to participate in mediation
Drafting and submission of closing arguments following the hearing
Administrative law judge's issuing of a decision
